Terms of Service
01 Overview and acceptance
These Terms of Service ("Terms") cover your use of aivilabs.io and of the products and services of AIVI Labs SEZC ("AIVI Labs", "we", "us"), a Special Economic Zone company incorporated in the Cayman Islands.
By placing an order, opening a report, or otherwise using our services, you agree to these Terms. If you don't agree, please don't use our services.
We may update these Terms. The current version is always at aivilabs.io/terms. When we change them, we update the effective date. Changes apply to orders placed after that date.
02 What we offer
AIVI Labs builds and runs software that measures what AI assistants say about businesses. We offer:
- Practice reports for dentists. For practices in the cities we've measured:
- Standard Report: your practice's mention rate on each AI platform we measure, your nearest competitors, and a 12-check website diagnostic.
- Competitive Bundle: everything in the Standard Report, plus a head-to-head comparison against three competitors you choose.
- Competitive Upgrade: turns a Standard Report into a Competitive Bundle.
- Studies and tracking. A study measured for your business, priced and described in a written quote, and repeat measurement (tracking) by subscription. Section 06 applies to these.
- Free material. Our published studies, and the free results page for each measured practice.
All our products are digital. Nothing physical is shipped.
03 Payment and billing
Online purchases. Practice reports are sold through our online reseller and Merchant of Record, Dodo Payments Inc. ("Dodo Payments"). When you buy online, you are buying from Dodo Payments, and Dodo Payments' own buyer terms apply to the payment. Dodo Payments collects and pays any applicable taxes. We never see or store your card details.
Studies and tracking are paid as set out in your quote.
Prices are in US dollars unless your quote says otherwise. Refunds are covered by our Refund Policy.
04 Delivery
Practice reports: after payment, we email you a link to your report, a web page you can keep. This is automatic and usually takes a few minutes. Please give an accurate email address at checkout. We aren't responsible for emails lost to a wrong address or a spam filter. If your report hasn't arrived within 48 hours, email support@aivilabs.io.
Studies and tracking: we deliver on the timeline and in the format set out in your quote.
05 What our results are, and what they aren't
Our results record what AI platforms and Google said when we asked them our questions, during the period we measured.
- They describe a moment. AI answers change from one ask to the next, and when platforms update their models. We measure many times so the numbers mean something, and every report says how accurate its numbers are. A later measurement can still differ.
- They are a measurement. They aren't a ranking, an endorsement, a certification or a prediction, and nothing we provide guarantees that a business will be named more often.
- We report what the AI said, not whether it's true. AI answers can contain mistakes about a business, such as an old address or a closed office. We record them as given.
- We don't control the AI platforms or Google, and we aren't affiliated with them. Their names are trademarks of their owners.
- We don't sell fixes, and we never charge a business to be included in a study.
06 Studies and tracking
These terms apply to every study and tracking subscription. Your quote adds the details: markets, platforms, timing and price. If the quote and these Terms disagree, the quote wins.
- We set the questions. Designing the questions is part of the study. We show them to you before the main run.
- The measurement belongs to AIVI Labs. You get a licence to use your results and the shared view of your markets for your own business.
- Other businesses in your market. We may offer other businesses named in a study their own results. The exception is a market where you hold exclusivity under a tracking subscription. Nobody receives another business's own detail, such as its custom questions or its sources write-up.
- We never say who commissioned a study.
- We may publish findings about how AI platforms behave. We never name you or your competitors without consent.
- Tracking subscriptions run for the period in your quote, monthly or quarterly. They renew unless you cancel before the next period begins. Cancelling stops future rounds; it doesn't refund a round already delivered.
- Exclusivity, where offered, covers only the exact markets named in your quote, for the term stated there.
07 Acceptable use
When you use our website and services, please don't:
- scrape, copy in bulk, or automate access to our site, reports or results pages;
- misrepresent your connection to a business in order to get its report;
- present our results as an endorsement, ranking or certification by AIVI Labs, or change them when you show them to others;
- resell or redistribute our reports or results without our written consent.
You may share your report within your business and with your marketing agency.
08 Intellectual property
Our software, methodology, question sets, report designs and published studies belong to AIVI Labs SEZC. Your report and results are licensed to you, not sold, for use in your own business. If you'd like to quote them publicly or in advertising, ask us first. We'll usually agree as long as the figures, platforms and dates are stated accurately.
You keep ownership of your website and anything you send us. For practice reports, you let us analyse your public website content to produce the website diagnostic.
09 Disclaimers
Our services are provided "as is" and "as available", without warranties of any kind, express or implied. That includes warranties of merchantability, fitness for a particular purpose and non-infringement.
Nothing we provide is legal, regulatory, medical or financial advice.
10 Limitation of liability
To the fullest extent the law allows, AIVI Labs SEZC and its officers, directors, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of our services.
Our total liability for any claim is limited to the amount you paid for the product or service the claim concerns.
11 Ending service
We may refuse an order, or stop providing a service, if we believe these Terms have been broken. If we do, we refund anything paid for work not yet delivered.
12 Governing law
These Terms are governed by the laws of the Cayman Islands, and the courts of the Cayman Islands have exclusive jurisdiction over any dispute. If you live somewhere with consumer protection laws that can't be waived by contract, those laws also apply.
